الاشارات الضوئية المرورية وعلاقتها بالمقاصد الشرعية

ملخص البحث
يهدف هذا البحث الموسوم بـ (الاشارات الضوئية المرورية وعلاقتها بالمقاصد الشرعية) الى بيان قاعدة مهمة ، رعاها الاسلام وتبناها ؛ حفظا لمقاصد الشارع الشريف الحاث على تتبع المصالح ودرء المفاسد عن المکلفين ، ومما  ينظم تحت ذلک تنظيم الاشارات الضوئية المرورية ، وآلية ضبطها وفق معايير عالية الجودة ، وانظمة دقيقة محکمة ، تراعى فيها حماية المقاصد الشرعية ولا سيما المقاصد الضرورية التي دعت الى حفظها وحمايتها جميع الملل والاديان ، فجاء هذا البحث ليرسم الخطوط العريضة ، ويتدارک الاخطار الناجمة عن سوء التخطيط أو الغفلة عن مراعاة المقاصد الشرعية في تصميمها ، مما يتحتم ابداعات جديدة وتنظيمات ذکية تواکب هذا الکم الهائل من المرکبات ، مع نقص شبکات الطرق والمنافذ في اکثر الکثر الدول ، لذا تلخص البحث في اعداد المحاور الآتية :
اولا : التأصيل الشرعي لحرکة المرکبات وحق استخدام الطريق ، ووضع لذلک القواعد العامة الاساسية التي تکفل السلامة التامة ، وعدم التضييق على المارة .
ثانيا : التقييد بالإشارات المرورية واجب شرعي ناشئ عن ادلة مقاصدية کثيرة ، ويترتب على ذلک مسائل مودوعة في طيات هذا البحث .
ثالثا : بيان العلاقة الوطيدة ، وتأثيرها سلبا وايجابا ، ودودا أو عدما في حفظ الضروريات ، ولاسيما النفس والعقل والمال والبيئة ، وقد افرد لکل منها مطلبا خاصا .
رابعا : وضع آليات جديدة ، تحث اصحاب المرکبات على الالتزام بسرعة محددة ، وتجبرهم على صيانة مرکباتهم بصورة مستمرة حفاظا على جميع مستخدمي الطريق .
خامسا : بعد ما قررته الدراسات العلمية عن الغازات السامة المنبعثة عن المرکبات نتيجة التوقف الحاصل بسبب الاشارات الضوئية ، وتأثيرها السلبي على البيئة ، فلذا اوضعنا الحلول حماية لهذا المقصد النبيل .
 
 
 
 
 
 
 
 
 
 
 
Abstract
    The present research , which s entitled, The traffic light and its relationship with the legal (shari'i) rules, aims at explaining one of the important rules adopted by Islam to keep the intentions of the noble legislation which urges  upon observing commonweal and fending off corruption for people. What is included under these rules is traffic light and its regulation according to high quality standards and accurate and succinct systems which consider the legal rules, especially those important ones which are considered and protected by all sects and religions.
  This research, then, draws the guidelines and, also, obviates the dangers resulted from the bad planning and the unaware follow of the legal rules in setting them. This requires  new creativity and clever regulation which meets the great quantity of automobiles and the decrease of paths and roads on most of the countries. This research is summarized in the following points:
1 – The legal (shari'i) founding of the automobiles' movements and the right of using roads, setting the general rules to secure safety and not confine passers.
2 – Restriction with the traffic light is a legal duty established due to legal rules on which many issues are based and, thus, impliedin this research.
3 – Explaining the steady relation between the traffic light and legal (shari'i) rules, its negative and positive impact in keeping necessities; especially the self, mind, money and environment. Each one is cited in a prerequisite.
4 – Setting new strategies to admonish car owners to be restricted with limited speed and maintain their cars periodically to keep all road passers safe.
5-  as the studies conclude  bad impact of the toxic gasses resulted from cars' exhausts while being stopped at traffic lights, solutions are proposed to keep this noble rule.
